The following terms and conditions are binding on you. Please make sure that you read them carefully and that you fully understand them before entering into this agreement.
Definitions:
"the Company" means Steinworks Sculpture.
"the Customer" means any party contracting with the
Company.
"Goods" means any equipment or other article or product
to be sold by the Company to the Customer.
Design right and copyright remains the property of the artist
and designer, Matt Stein. Any reproduction or part thereof or
any redesigned, modified or adapted form of designs and artworks
shown here and in any proposal is an infringement of copyright
and will require the written permission of Matt Stein of Steinworks
Sculpture and will be dealt with accordingly.
All published prices are correct at time of print. The Company
retains the right to change without prior notice.
(a) Payment for the goods shall be made in two installments. A
50% deposit will be made by the client in agreement of the order
confirmation. A final payment of the remainder will be paid upon
delivery. Each consignment shall be invoiced to the Customer together
with the cost of carriage where appropriate on the acceptance
of an order and except as otherwise agreed the Goods shall not
be delivered before payment is made.
(b) The Company reserves the right to charge interest at Bank
of Scotland base rate from time to time plus 3% on all overdue
accounts.
In the event that payment for Goods is overdue in whole or in
part or the Consumer becomes bankrupt or has a receiver, liquidator
or administrator appointed in respect of its business or
is otherwise shown to be insolvent, the Company may (without prejudice
to its other rights) recover or resell the Goods or any of them
and may enter upon the Customers premises for that purpose.
• Property of the goods shall not pass to the customer until the Company has received payment in full.
In the event of part payment and any payment dispute after Goods
have been delivered to the Customer, the Customer will
(a) Be wholly responsible to keep the Goods insured to their full
value against all risks.
(b) Keep the Goods in its possession and control intact and in
a good state of repair and condition.
(c) Upon request inform the Company of the whereabouts of the
Goods and procure that the Company shall have access thereto at
all times on reasonable notice.
The Customer is responsible for obtaining all necessary planning
permission and local authority consents and permissions for any
work to be carried out. In carrying out any work Steinworks Sculpture
will assume that the necessary consents and permissions have been
obtained and accepts no responsibility whatsoever in the event
that they have not.
Where any valid claim based on any defect in the quality or condition
of the goods or their failure to meet specifications must be notified
to the Company within 48 hours.
The liability of the Company is limited to replacement of the
goods free of charge or at its opinion to make a fair cash allowance
not exceeding the invoice of the goods.
The Company's liability will not extend to any consequential loss
or damage however incurred.
Warranty
Unless otherwise stated, Steinworks Sculpture guarantees to you
that Steinworks Sculpture Products will be free from defect for
24 months from delivery. Should Product be faulty within this
period, Steinworks Sculpture will repair or replace Product within
reasonable time. Steinworks Sculpture does not give a warranty
guarantee protection for:
a) damage caused by incorrect installation, use, modifications or repair by any unauthorised 3rd party or yourself;
b) damage caused by any party (except Steinworks Sculpture) or other external force;
c) fitness for any particular purpose;
d) any instruction given by you and correctly performed by Steinworks Sculpture.
The statutory rights of any customer buying as a consumer are
not affected by these conditions.
